In the public eye, modern computer- and robot-assisted treatment approaches are often perceived as already available. Excessive expectations of the new \"high-tech\" treatment methods are fueled. However, the path from basic research to clinical application is complex and risky and often requires long periods of time. New diagnostic and treatment methods must be transferred into clinical routine in order to achieve sustainable improvements for patients and society and to enable acquisition of scientific knowledge. Translation is very complex and requires teams of engineers, clinicians and pre-clinicians, statisticians, health economists, sociologists, and ethicists. Their cooperation must be ensured financially and by infrastructure for longer periods of time. In this sense, we must already reflect today what may come after the solutions propagated by us.<\/p>\n<p>Promoting translational research in academia requires courage and risk-taking. Courage to go for ways that have not yet gone and risk-taking to fail. This not only applies to us researchers themselves, but also to our deans and presidents, our universities and society that ultimately funds the research. Wie bereits mehrfach in unserem Newsletter berichtet, hat die MDR erhebliche Auswirkungen auf die Verf\u00fcgbarkeit wichtiger Medizinprodukte, insbesondere aufgrund der komplexen Re-Zertifizierungsverfahren und des Wegfalls zahlreicher Bestandsprodukte.<\/p>\n<p>Angesichts wachsender Kritik aus Kliniken, Herstellern und Fachgesellschaften und der drohenden Versorgungsl\u00fccken bei essenziellen Medizinprodukten gelang es, den Gesetzgebungsprozess erneut zu \u00f6ffnen. Eine Novellierung befindet sich in Vorbereitung, flankiert von \u00dcbergangsfristen:<\/p>\n<p>Unter der Bedingung, es liegt ein Antrag bis 26. Mai 2024 vor und es gibt einen Vertrag vor Sept 2024 mit der benannten Stelle, dann:<\/p>\n<ol>\n<li>Bestandsprodukte der Klassen I und IIa bleiben bis 2028 g\u00fcltig.<\/li>\n<li>Hochrisikoprodukte der Klassen IIb und III sind bis 2027 zertifiziert.<\/li>\n<\/ol>\n<p>Bis zum 06. Oktober 2025 war die \u00d6ffentlichkeit, insbesondere Angeh\u00f6rige der Gesundheitsberufe, Patientenvertreter und Industriepartner,\u00a0 aufgefordert, Stellungnahmen zur MDR einzureichen. Nun bleibt abzuwarten, wie die Europ\u00e4ische Kommission die eingegangenen Vorschl\u00e4ge aufgreift und welche konkreten Anpassungen daraus entstehen.<\/p>\n<p><strong><u>Hintergrundgespr\u00e4che im Europ\u00e4ischen Parlament \u2013 Br\u00fcssel<\/u><\/strong><\/p>\n<p>\u201eThe Future of the Medical Device Regulation (MDR)\u201d\u00a0 Stakeholder-Dialog, Landesvertretung Baden-W\u00fcrttemberg, 23.05.2025<\/p>\n<p>Teilnehmende u. a.: Michael Kleiner (Ministerialdirektor, Wirtschaftsministerium BW), Leonie Dirks (Ministerialdirektorin, Sozialministerium BW), sowie zahlreiche Vertreter europ\u00e4ischer Gesundheitsministerien, Kliniker und Unternehmensdelegationen \u2013 darunter Florian Brunschoen, Alexander Reiprich, Uwe Spetzger, Wolfram Lamad\u00e9, Folker Spitzenberger, Martin Leonhard, Peter Bischoff-Everding, Csaba Kontor.<\/p>\n<p><strong>Zielsetzung des Dialogs<\/strong><\/p>\n<p>Die Europ\u00e4ische Kommission verfolgt eine gezielte \u00dcberarbeitung der MDR, um<\/p>\n<ul>\n<li>Verwaltungsaufwand zu reduzieren,<\/li>\n<li>Berechenbarkeit und Kosteneffizienz zu erh\u00f6hen,<\/li>\n<li>gleichzeitig ein hohes Ma\u00df an Patientensicherheit zu gew\u00e4hrleisten.<\/li>\n<\/ul>\n<p>Im Mittelpunkt steht die Frage, wie der urspr\u00fcngliche Gedanke der Verordnungen \u2013 Sicherheit und Innovation \u2013 wieder in Balance gebracht werden kann.<\/p>\n<p>Einreichung von Stellungnahmen war bis 6. Unternehmen, die fr\u00fchzeitig re-zertifiziert haben, stehen nun paradoxerweise im relativen Wettbewerbsnachteil. Die Forderung nach Planungssicherheit bleibt zentral.<\/li>\n<li>Neuer politischer Auftrag an die EU-Kommission<br \/>\nDas Europ\u00e4ische Parlament verabschiedete eine neue Entschlie\u00dfung zur gezielten Reform der MDR. Die Kommission wurde beauftragt, Anfang 2025 mittels Durchf\u00fchrungsrechtsakten konkrete Korrekturen vorzunehmen.<\/li>\n<li>Praktischer Fortschritt<br \/>\nBedienungsanleitungen m\u00fcssen k\u00fcnftig nicht mehr zwingend in gedruckter Form beigelegt werden \u2013 ein Schritt hin zu nachhaltiger und digitaler Produktdokumentation.<\/li>\n<li>Alternativer Vorschlag: Das Schweizer Modell, wo MDR- und FDA-zertifizierte Produkte in der Patientenversorgung eingesetzt werden d\u00fcrfen. Dies w\u00fcrde, wennn es europaweit zur Anwendung k\u00e4me zu einem regulatorischen Wettbewerb f\u00fchren, als Vorteil f\u00fcr die Innovation und Verf\u00fcgbarkeit von Medizinprodukten, mit dem Nachteil der partiellen Aufgabe von Staatshoheit.<\/li>\n<\/ol>\n<p><strong>Regulierung im Spiegel gr\u00f6\u00dferer gesellschaftlicher Fragen<\/strong><\/p>\n<p>Im Rahmen der Gespr\u00e4che wurden grundlegende \u2013 teils philosophische \u2013 Fragen aufgeworfen, die weit \u00fcber den regulatorischen Rahmen hinausreichen:<\/p>\n<p><strong>Schl\u00fcsselfragen<\/strong><\/p>\n<ul>\n<li>Ist Regulierung Ausdruck von F\u00fcrsorge oder von Misstrauen?<\/li>\n<li>Kann absolute Sicherheit \u00fcberhaupt erreicht werden \u2013 und welchen Preis zahlen wir f\u00fcr diesen Anspruch?<\/li>\n<li>Entlastet Regulierung Fachkr\u00e4fte oder entm\u00fcndigt sie?<\/li>\n<li>Was passiert, wenn Verantwortung in einem System zunehmend delegiert oder diffus wird?<\/li>\n<li>F\u00f6rdert eine \u201eNull-Risiko-Kultur\u201c medizinische Qualit\u00e4t \u2013 oder behindert sie Innovation und Selbstverantwortung?<\/li>\n<li><strong>Psychologische und philosophische Dimensionen<\/strong><\/li>\n<li>Gesellschaften neigen aufgrund von Verlustaversion und Angst vor Haftung zu immer st\u00e4rkerer Absicherung.<\/li>\n<li>\u00dcberregulierung f\u00fchrt zu Hemmung von Innovation und gef\u00e4hrlichem Entzug von Technik (T-Drainagen, HerzKatheter, Stents, Mikroinstrumente in der Neurochirurgie etc.)<\/li>\n<li>Ohne Vertrauen in Expertise entsteht ein Teufelskreis zunehmender B\u00fcrokratisierung.<\/li>\n<li>Resilienzforschung zeigt: Fortschritt erfordert die Bereitschaft, Unsicherheiten auszuhalten.<\/li>\n<li><strong>Gesellschaftliche Gegenstrategien<\/strong><\/li>\n<\/ul>\n<ol>\n<li>St\u00e4rkung einer Verantwortungskultur: \u00c4rzte, Ingenieure und Patienten als Co-Gestalter.<\/li>\n<li>Vertrauensbildung \u2013 Ausbau fachlicher Selbstkontrollmechanismen (Fachgesellschaften, Peer Review).<\/li>\n<li>\u201eWohl des Patienten als oberstes Gut statt nur die isolierte Sicherheit eines isolierten Medizinproduktes, create a space for identifying medical technology problems and jointly developing new solutions.<\/p>\n<p>With the \u201cYoung Surgineers\u201d we would like to offer the young scientists in our community a platform for networking and dialog, be it on general questions relating to the topic of doctorates and personal careers in science, clinics or industry, on their own research, or even on further research projects and the search for fellow campaigners (publications, applications, etc.).<\/p>\n<p>All interested scientists (postdocs, professors, etc.) from the CURAC community are welcome to participate. However, the special focus of our working group should be on the young scientists among us.<\/p>\n<p class=\"translation-block\">The first planned meeting will take place as part of a workshop day on 23.08.2023 in Basel, and will provide a direct technical and thematic introduction to the CURAC Annual Conference (24.08.2023-26.08.2023).\nParticipation in the workshop is free of charge and therefore does not entitle the participant to attend the CURAC Annual Conference.
